Fighting for the 14th Amendment

Letter #7: The War on Tyranny

Dear Fellow American,

As we enter 2025, much is on the horizon, knowing full well that wealthy oligarchs have strengthened their filthy grip on this country. It will be our job to hold the line.


America is neither a system of government nor an economy. Instead, it is a solemn promise that people are not born to be the subjects of tyrants, but rather to live a life fully in line with their creator-endowed, inalienable rights.


The time has come for us to fight for every inch of that promise.


Holding government accountable

Henceforth, whenever practical, I will refer to our white supremacist overlords as those who shall not be named," and their henchmen as cronies."


The first reason for this is that they aren't worthy to be on your tongue. You are what makes America great, not them. The only thing they have is money, and they live with it miserably, filling their lives with odds and ends of no meaning at the expense of everything that makes life invaluable. Their money gives them influence to get more stuff, and they use that influence indiscriminately to try to satiate their gaping, black, and insatiable souls.


The second reason for this is that we are a land of laws, and it is our government that makes those laws. Just because those who shall not be named" currently hold incredible sway over our government, this does not mean that it will always be so. We have been in a position similar to this before during the Gilded Age of American history when the robber barons also used their money to wreak havoc on corrupted democratic institutions.


By holding the government accountable, as opposed to giving our attention to those who shall not be named," we put the weight of the people where it belongs - behind the creators of our laws.


The 14th Amendment is under attack

That being said, I believe there is one place to start - the 14th Amendment. It is under direct attack, and with it our constitution. This country (as we know it) cannot endure unless our constitution is protected at all costs.


It is our only bulwark from tyranny.


The constitutional amendment process

Amendments can't be changed by executive order. The amendment process was specifically designed to be cumbersome to prevent whimsical changes, and so changing the constitution can be done in ONLY one of two ways, as per Article V:


By Congress

  1. Two-thirds of both the House and Senate vote to propose an amendment

  2. Three-fourths of state legislatures (or ratifying conventions) in three-fourths of states ratify it.


By a convention

  1. Two-thirds of state legislatures ask Congress to call a convention to propose an amendment.

  2. Three-fourths of state legislatures (or ratifying conventions) in three-fourths of states ratify it.


If one of these doesn't occur, nothing else - not a corrupted SCOTUS, president, Congress, co-president, or any other force on earth - can lawfully change the Constitution.


Natural-born citizenship, abortion, and transgender care

The president-elect has vowed to eliminate the citizenship rights of migrant-born children on command. He justifies this by saying that it's what other nations do. But the United States doesn't operate by the laws of other nations; it operates by its own laws within the confines of the constitution, and Section 1 of the 14th Amendment is clear:

All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.

Additionally, SCOTUS has set a long precedent of interpreting this section as a protection of privacy, which has been applied to many Supreme Court cases, such as those regarding the use of contraceptives and women's rights to abortion.


Transgender care for minors also falls under this protection of privacy. Every reputable health organization, such as the American Medical Association (AMA), states that decisions about medical care for transgender children should be made within the patient-physician relationship, and that this care is critical for the overall health and well-being of children struggling with gender identity.


The insurrection clause

Arguably, the most imminent threat to the constitution is to Section 3 of the 14th Amendment, which will be violated upon the president-elect taking office:

No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability.

Per section 5 of this same amendment, Congress has full power to enforce it, without any interference from another branch of government:

The Congress shall have power to enforce, by appropriate legislation, the provisions of this article.

That Congress - in which all members have sworn an oath to protect the constitution against enemies foreign and domestic - has thus far allowed the blatant disregard of the insurrection clause is troubling.


We are not being loud enough, and either our elected officials are too fearful of repercussions, or they are bought. I'm not sure which is worse.


The power is ALWAYS with the people

The 14th Amendment is neither the first nor the last to be targeted. Once democracy begins to rot, it becomes all the easier to hack away at it.


Historical precedent shows us that dictators work tirelessly to suppress the media, restrict civil liberties, erode norms, and disseminate propaganda - tactics all of which aim to divide the people.


This's because successful dictators understand that real power is always with the people, and so did the organizers of the Declaration of Independence:

That to secure these rights, Governments are instituted among Men, deriving their just powers from the consent of the governed, --That whenever any Form of Government becomes destructive of these ends, it is the Right of the People to alter or to abolish it, and to institute new Government, laying its foundation on such principles and organizing its powers in such form, as to them shall seem most likely to effect their Safety and Happiness.

We have the power when we stand together. Don't let yourself be isolated, or to buy into propagandic rhetoric aimed at creating massive splits within the population.


Final Note

Whatever may come this year, and in the years to come, know that I will be standing with you - along with every other who believes in the promise of America - to resist tyrannical rule.
